Pashlabs Copyright Policy
Pashlabs respects the intellectual property rights of others and expects its users to do the same. It is our policy, in appropriate circumstances and at our discretion, to disable and/or terminate the accounts of users who repeatedly infringe the copyrights or other intellectual property rights of others.
Reporting Copyright Infringement
If you believe that your copyrighted work has been infringed by content accessible through the Pashlabs service (e.g., via a Pashling configured by one of our users), please let us know.
Initial Reports & Quick Concerns:
For quick concerns, or if you are unsure about the formal DMCA process, you can make an initial report through our Support Page. Please provide as much detail as possible, including:
- A description of the copyrighted work you believe has been infringed.
- The location of the allegedly infringing material on Discord (e.g., Server ID, Channel ID, Bot ID/Name, relevant message links or timestamps if possible).
- Your contact information.
This allows us to conduct a preliminary review. However, for a formal takedown request that initiates the legal DMCA process, a complete DMCA Notice (as detailed below) is required.
Formal DMCA Takedown Notice:
To submit a formal DMCA Notice of Alleged Infringement, which is necessary for us to take legally mandated action such as disabling access to the material, please follow the instructions below. This formal process is particularly important if you are a copyright holder or an authorized agent acting on their behalf.
In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Pashlabs will respond expeditiously to formal claims of copyright infringement committed using the Pashlabs service that are reported to Pashlabs's Designated Copyright Agent.
Designated Copyright Agent for Formal DMCA Notices
Formal DMCA Notices must be sent to our Designated Copyright Agent:
Pashlabs Copyright AgentEmail: legal@pashlabs.com
Subject: DMCA Notice of Alleged Infringement
Verification for Organizational Claims: If you are reporting on behalf of a company or organization, please ensure your communication comes from an official company email address (e.g., yourname@company.com) or provide other verifiable authorization. We may need to take steps to verify your affiliation.
DMCA Notice of Alleged Infringement ("Notice") Requirements
To be effective, a formal DMCA Notice must be in writing and contain the following information:
- Identify the copyrighted work that you claim has been infringed, or - if multiple copyrighted works are covered by this Notice - you may provide a representative list of the copyrighted works that you claim have been infringed.
- Identify the material or link you claim is infringing (or the subject of infringing activity) and to which access is to be disabled, including at a minimum, if applicable, the URL of the link shown on the Service or the exact location where such material may be found. (Please be specific - providing Bot IDs, User IDs, Server IDs/Channel IDs, and timestamps if possible, as this greatly assists our investigation).
- Provide your company affiliation (if applicable), mailing address, telephone number, and, if available, email address. Your email address should ideally be one that can verify your identity or affiliation if reporting as an organization.
- Include both of the following statements in the body of the Notice:
- "I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."
- "I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."
- Provide your full legal name and your electronic or physical signature.
Deliver this formal Notice, with all items completed, to Pashlabs's Designated Copyright Agent via email. Vague or incomplete formal notices may not be processed. Submitting intentionally misleading reports of infringement may lead to liability.
Counter-Notice Procedure
If you believe that material you configured your Pashling to output was removed or access to it was disabled by mistake or misidentification as a result of a formal DMCA Notice, you may file a counter-notification ("Counter-Notice") with us by submitting written notification to our copyright agent.
Pursuant to the DMCA, the Counter-Notice must include substantially the following:
- Your physical or electronic signature.
- An identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
- Adequate information by which we can contact you (including your name, postal address, telephone number, and, if available, email address).
- A statement under penalty of perjury by you that you have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
- A statement that you will consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside the United States for any judicial district in which the Service may be found) and that you will accept service from the person (or an agent of that person) who provided the Service with the complaint at issue.
Deliver this Counter-Notice, with all items completed, to Pashlabs's Designated Copyright Agent. The DMCA allows us to restore the removed content if the party filing the original DMCA Notice does not file a court action against you within ten business days of receiving the copy of your Counter-Notice.
Repeat Infringer Policy
In accordance with the DMCA and other applicable law, Pashlabs has adopted a policy of terminating, in appropriate circumstances and at Pashlabs's sole discretion, users who are deemed to be repeat infringers. Pashlabs may also at its sole discretion limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
